NEWS FROM THE NATIONAL ASSOCIATION
EPA’s Recent Action on Refrigerants. This week the Environmental Protection Agency (EPA) announced new approved “climate-friendly” refrigerants.  The new rule is part of the Administration’s Climate Action Plan to decrease emissions of potent greenhouse gases.  Click here to read about EPA’s announcement this week.
Supreme Court Begins Work on Landmark Case.  This week the Supreme Court began oral arguments in King v Burwell…the petitioners in this case want the Court to rule that the Obama Administration must abide by the provisions of the Affordable Care Act regarding  insurance subsidies.  The text of the Affordable Care Act law requires that all subsidies must flow through exchanges established by the states, not the federal government.  However, due to the refusal of 36 states to set up their own exchanges, the federal government established the exchanges in those states.  In other words, only state exchanges may offer subsidies-which would disallow millions of Americans subsidies.  The ruling is expected in June as the Court ends its current term. 
QSC Members Support Education.  A total of 62 of the QSC members and industry partners present at the Power Meeting in Scottsdale last week made contributions to the PHCC Educational Foundation in support of education. Those gifts added up $15,629 - including a generous $2,000 in matching gifts from A.O. Smith. Add to that the 1/3 matching funds InSinkErator & Ferguson provide, and all combined, the QSC members at the Power Meeting generously raised $20,840 in support of the Foundation’s educational mission. For those who could not attend, but would like to contribute, you can do so on this webpage. The Foundation’s 2015 fundraising goal is $155,000.
Death Tax Bill Introduced.  This week Congressmen Kevin Brady (R-TX) and Sanford Bishop (D-GA) introduced HR 1105, the “Death Tax Repeal Act of 2015.”  PHCC National and 81 other organizations sent a coalition letter up to Capitol Hill in support of the legislation.  To view the letter click here.  PHCC will keep you informed about the progress of this bill.

NEWS FROM THE NATIONAL ASSOCIATION
George Meany Award Presented.  On Tuesday PHCC National President Kevin Tindall and a group of members and staff attended the Inaugural George Meany Award Gala in Chicago.  The award was presented to United Association General President Bill Hite by the Boy Scouts of America in recognition of his contributions to the youth in America.  Congratulations Bill!
Career and Technical Education Bill Introduced in the Senate.  S.191 was introduced in the Senate this week and has been referred to the Senate Committee on Health, Education, Labor and Pensions.  The legislation would amend the Carl D. Perkins Career and Technical Education Act of 2006 to raise the quality of career and technical education programs and to allow local eligible recipients to use funding to establish high-quality career academies.  The bill was introduced by   Senators Rob Portman, (R-OH) and Tim Kaine (D-VA), who Chair the PHCC-supported Senate Career and Technical Education Caucus.  The Chairs of the House Career & Technical Education Caucus, Congressmen Glenn Thompson (R-PA) and Jim Langevin (D-RI) are true PHCC supporters who have both made several appearances at PHCC’s Legislative Conference over the past few years.
Senate Small Business Committee Set and Ready for Business.  Committee assignments in the House and Senate are key to PHCC.  We build relationships with the committees that have jurisdiction over the issues that impact the plumbing-heating-cooling industry.  As we all know, the Senate has changed leadership and one of the key committees to PHCC is now ready for business – the Senate Small Business Committee.  PHCC-supported freshman Senator Joni Ernst (R-IA) is on the committee.  Please review the committee roster to see who is on the committee.  If you have a close relationship with a committee member, please notify Mark Riso.
The PHCC Union-Affiliated Contractors will meet February 2-4 in Palm Coast, FL. 
On January 30th this report will be presented to the PHCC Board of Directors in San Antonio, TX. 
This report will return on February 13th.

NEWS FROM THE NATIONAL ASSOCIATION
Congress Releases 114th Congressional Calendar.  This week House Majority Leader Kevin McCarthy (R-CA) released the 114th Congressional calendar for 2015.  The calendar confirms that Congress will be in session on the dates selected for the 2015 Legislative Conference (April 22-23, 2015).  PHCC National will soon provide program and registration information.  We hope you will plan to attend this important event. 
Congressman Chabot Recommended as New Small Business Committee Chairman. This week the House Republican Steering Committee published their committee Chair recommendations for the next Congress.  Of particular note—Congressman Steve Chabot (R-OH), who was a speaker at this year’s PHCC Legislative Conference, has been recommended to serve as the Chairman of the House Small Business Committee.  Also, Congressman John Kline (R-MN) was recommended to Chair the House Education & the Workforce Committee.  Both Congressman Chabot and Congressman Kline were supported by the PHCC-PAC.  Each of these committees are key to PHCC’s advocacy efforts on Capitol Hill.  The Chair recommendations still need to be ratified.
Congress Needs to Pass Another Budget. In September 2014, Congress passed and the President signed a Continuing Resolution (CR) to keep the government funded until December 11, 2014.  Congress must pass (and the President must sign) a budget or another CR on or prior to December 11, 2014 to keep the government running. 
PHCC Educational Foundation Seeks New Committee Members for 2015. The Foundation relies on the expertise of its volunteers to help create valuable educational programs and resources. If you are interested in joining the committed group of Foundation volunteers that are making a difference in the industry, contact Cindy Sheridan at sheridan@naphcc.org.  
The PHCC National Office will be closed next Thursday and Friday in observance of Thanksgiving.  The PHCC national board and staff give thanks for our great members, our effective chapters and our outstanding volunteer leaders.  Happy Thanksgiving!

OREGON PHCC PRESIDENT LOEWEN TESTIFIES AT APPRENTICESHIP HEARING
Oregon PHCC President Ron Loewen (Best Heating in Scio) testified to the Joint Task Force on Apprenticeships during a hearing  in the Capitol Building September 15.  President Loewen lead the task force in a very information discussion on the problems facing Oregon contractors who try to participate in apprenticeship programs.  The apprentice indenturing process needs to be fixed and President Loewen explained why it is depressing employment opportunities.  To read President Loewen’s testimony, click HERE

PHCC Begins Work on Upcoming Congressional Elections.  The PHCC Government Relations and PAC Committee met yesterday to begin the process of determining which Members of Congress—and candidates for Congress—to support in the November 2014 elections.  The committee would like your help.  Please let us know who you believe should receive support from PHCC’s Political Action Committee.  We will conduct the research (i.e. voting record, overall support to PHCC, etc.) to determine who should receive PHCC-PAC funding.  Although PHCC staff conducts the research, the decision about who receives funding is made by PHCC members.  To submit a recommendation, please contact Mark Riso at riso@naphcc.org or 703.752.9871.
Surviving an OSHA Inspection.  OSHA’s enforcement efforts have changed dramatically in recent years and if you haven’t had an inspection recently, chances are you will. During the Foundation’s  next free member webinar on Wednesday, Sept. 10 at 3 p.m. ET, PHCC of Ohio General Counsel, Bob Dunlevey, a Board Certified Labor and Employment Law Specialist, will discuss the policies and procedures you need to have in place to deal with an inspection. Bob will also address one of OSHA's newest areas of emphasis—heat related illnesses. Click here to register.
Apprentice Contests Boom in 2014!  At CONNECT 2014 in New Orleans, be sure to stop by and watch the 21 plumbing apprentices and 13 HVAC apprentices who will be competing in the PHCC national apprentice contests. PHCC—National Bylaws Amendments.  No amendments to the national bylaws have been submitted for consideration at the Annual Business Meeting that will be held on October 10th in New Orleans.      
Congress Back In Session Next Week.  Congress will be back in session next week following the annual August recess.  This week PHCC, along with the Air-Conditioning, Heating, and Refrigeration Institute (AHRI), Air Conditioning Contractors of America (ACCA), Heating, Air-Conditioning, and Refrigeration Distributors International (HARDI) and North American Technician Excellence (NATE), hosted a “Capitol Hill Staff Appreciation Reception.”  Though the reception was geared toward Capitol Hill staff, it is an important engagement for PHCC and the other industry associations.  Capitol Hill staff are the front line of communication and engagement for the industry and the relationships are critical to the success of any advocacy effort.

While the Government is Shutdown-Small Business is Shutout.  There isn’t much more to say about the current state of affairs as they relate to the government “shutdown.”  At 12:00 am on Tuesday October 1, 2013, the federal government partially closed its doors.  Though the shutdown is not pleasant, the real battle is yet to come over the debt limit.  As PHCC National has pointed out many times, it isn’t necessarily the issues Congress is considering that may be harmful to small business—it is the issues Congress is not considering.  The focus on the government shutdown and health care (and soon the debt limit) have all but drained and taken away lawmakers’ attention to many other important small business issues.  Heard on the Hill…it is becoming increasing clear in Congress that reopening the government, raising the debt limit and setting spending levels for the next year are being rolled into one package.  PHCC National will keep members informed of all developments. 
Health Care Exchanges are Available But the Devil May be in the Details.  This week, the new health care “Exchanges” went live.  In essence, the exchanges provide information and access to insurance plan research, price comparisons, and insurance plan applications-as a result of the Patient Protection Affordable Care Act (ACA).  But there is reason to be cautious.  Whether you support or oppose the ACA, there are warnings about the security risk the exchanges may pose in terms of data collection and storage.  Also, the subsidy calculators may not be completely accurate at this time.  An article in the October 2, 2013 edition of The Wall Street Journal emphasized these issues.  Remember that insurance offered through the exchanges will go into effect January 1, 2014.  There is plenty of time for members to carefully research health insurance options while allowing issues involved with the exchanges to be worked-out.
Bill Erickson Recognized.  This week PHCC member Bill Erickson (C.J. Erickson Plumbing Co., Alsip, Ill.) was presented with the IAPMO Joseph Kneidinger Green Contractor of the Year Award.  In particular, Bill was recognized for his work in chairing the IAPMO Green Plumbing and Mechanical Code Committee.  Congratulations Bill! 
Keep Your Eye on the Health Care Ball.  Regardless of current House and Senate actions on the federal budget and health care, the Patient Protection and Affordable Care Act (ACA) is scheduled to go into effect January 1, 2014. 
Today, a front page article in The Wall Street Journal reports that the “…insurance exchanges  won’t be ready to accept online applications from small businesses when the program launches [next] Tuesday.”   
With so much news/information/confusion about the new upcoming health care law, let’s focus on a few issues that you need to know now:
If you’re an employer (regardless of how many you employ or whether you offer health insurance or not) by October 1, 2013, you must provide each of your employees a notice of the existence of the “Marketplace” (more commonly known as the Exchange).  Please refer to the links below to download model notices you can use:

The “Marketplace” – click here – is the government service that will serve as the center of information for researching and buying health insurance.  The website is live now, and PHCC encourages all members to review the information offered on the website (there is also a section on the site for what small businesses need to know).
The Administration has delayed for one year the imposition of penalties to large employers (50 or more employees) if they don’t offer health care insurance to their employees.  However, the individual mandate and penalties are still in effect.

UPDATE FROM NATIONAL PHCC
“Tenant Star” Amendment to be Offered in the Senate Next Week.  U.S. Senators Michael Bennet (D-CO) and Kelly Ayotte (R-NH) have filed a PHCC-supported amendment to S. 1392, the Energy Savings and Industrial Competitiveness Act of 2013, also known as “Tenant Star.”  PHCC signed a letter last June supporting legislative language promoting Tenant Star, which is an initiative that encourages cooperation by landlords and tenants in commercial buildings to save energy as leased spaces in these structures are designed, constructed, used and occupied.  S. 1392 is expected to be brought-up in the Senate following deliberations over the issue of Syria.  Click here to read the letter sent by PHCC and other cooperating organizations.
The Push for Further Energy Efficient Tax Deductions.  PHCC recently signed onto a draft letter to be sent to the House Ways and Means Committee and the Senate Finance Committee, regarding the tax deductions of Section 179D of the IRS Tax Code, which is set to expire at the end of this year.  The letter will be sent to Capitol Hill next week when Congress goes back into session.  Section 179D  is a tax deduction allowing for cost recovery for energy efficient windows, roofs, lighting, heating and cooling systems that meet “certain energy savings performance targets.”  PHCC has been meeting with other interested organizations and associations, and will continue to provide members with information as Congress begins to review tax deduction extensions such as 179D. 
R-22a --- The Continued Fight Against Dangerous Refrigerant Substitutes.  PHCC continues to work with the U.S. Environmental Protection Agency (EPA) to support the agency’s ongoing investigation against R-22a.  EPA has issued a stern warning to propane manufacturers and sellers, home owners, home improvement contractors and air conditioning technicians regarding the dangers of refrigerant substitutes such as R-22a.  PHCC has published information that R-22a is not EPA-approved and highlighting the severe dangers posed by R-22a.  Although EPA does not comment on ongoing investigations, EPA has issued an enforcement letter to a manufacturer of the alternate refrigerant which in essence, accuses the company of violating the Clean Air Act and more specifically, provisions of the “Significant New Alternatives Policy” (SNAP).  PHCC’s mission to protect the health, safety and comfort of the nation compels our continued involvement in this issue and PHCC again warns members about the use of R-22a.  PHCC continues to work with EPA on this issue and urges members who have experienced or are aware of a specific incident involving R-22a to contact the EPA attorney assigned to the issue:  Louise Gross, Associate Regional Counsel, U.S. Environmental Protection Agency - 312-886-6844 or gross.louise@epa.gov.

OSHA has adopted the Globally Harmonized System (GHS) of Classification and Labeling of Chemicals as the new standard for hazard communication. Effective December 1, 2013, employers must ensure that employees are trained on the new labeling elements and Safety Data Sheet formats. Training should include: What is GHS? Understanding GHS labels. And, Safety Data Sheets (formerly MSDS). Federated clients are encouraged to contact Federated for free assistance.

OREGON FIRE CODE CHANGES COMING
The Office of State Fire Marshal intends to amend Oregon Administration Rule 837 Division 040 to:
(1) Adopt the 2012 International Fire Code with Oregon amendments (2014 Oregon Fire Code), with an effective date of April 1, 2014; (2) Remove mid-cycle Oregon amendments to the 2010 Oregon Fire Code; and (3) Change the edition dates of the Oregon Structural Specialty Code and Oregon Mechanical Code from 2010 to 2014.

A public hearing is scheduled:  June 18, 2013 / 9:00 A.M. at the Office of State Fire Marshal, 4760 Portland Rd NE, Salem, OR 97305.  The last day for public comment is June 18, 2013 at 5:00 P.M.  If you have questions about the rule content, please contact Deputy State Fire Marshal John Caul at (503) 934-8269 or email him at john.caul@state.or.us

COLUMBIA (PORTLAND AREA) CHAPTER MEETINGS

MANUAL  D CERTIFICATION CLASS FROM ORACCA
Residential duct systems have a direct and significant effect on equipment size, efficiency, malfunctions, envelope infiltration, operating costs, utility, demand loads, vent performance, indoor air quality, ambient noise and more important, occupant comfort and owner satisfaction.  And, equally important, a direct bearing on the reputation of your company!  ORACCA is offering eight hours of training and testing.  Those passing the test will receive a certification card from ORACCA.  Each participant is required to purchase and bring their own copies of manuals D & T to the class.  Seating is limited, so register early to ensure a seat.  For more information, click on this link

UPDATE ON OREGON’S CHIEF PLUMBING INSPECTOR
From ORPHCC President Jay Hansen, who is representing Plumbers on the selection committee:  “After 20+ years of serving the State and our Industry as Chief Plumbing Inspector, Terry Swisher is retiring.  On February 28th I partnered with representatives from Local 290, PMCA and the DCBS and conducted interviews for the new Chief Plumbing Inspector.  All the candidates come from the inspection field already, have solid backgrounds and each would do well.  There was one clear-cut favorite amongst the panel and very shortly we will all hear who will be replacing Terry.  Those will be hard shoes to fill and we all will miss Terry and thank him for his diligent service.  ORPHCC would also like to thank Mark Long, the Building Codes Division Director, for reaching out to and engaging members of our industry to be part of this important transition.”

ORPHCC PRESIDENT JAY HANSEN ON OREGON MECHANICAL BOARD
ORPHCC President C. Jay Hansen was nominated by Governor John Kitzhaber to a post on the Oregon State Mechanical Board.  The Governor’s nomination was issued on November 20th.  The nomination was subject to confirmation by the Oregon State Senate.  Jay Hansen appeared before the Senate Rules and Executive Appointments Committee on December 10th.  The committee forwarded his nomination unanimously to the full Senate, which approved his nomination on December 12.  The slot is a four year term which will expire on November 12, 2016. 

TERRY SWISHER ANNOUNCES RETIREMENT

ORPHCC BOARD MEMBER TESTIFIES AT PLUMBING BOARD
Steve Houston, an ORPHCC Board Member, testified before the Plumbing Board on October 18th on proposed changed to the Plumbing Specialty Code.  Houston was one of only two plumbers representing the industry on a special panel reviewing FOG issues.  As part of a cooperative agreement with sewer purveyors, ORPHCC, BCD and other stakeholders supported some changes to the Plumbing Code in exchange for the sewer purveyors agreeing to not create additional hook-up regulations beyond the Plumbing Code.  To review a copy of the written testimony ORPHCC submitted, click HERE

BCD FILES NEW RULE FOR RADON MITIGATION STANDARDS
BCD recently filed a rule that amends the 2010 Oregon Structural Specialty Code for Radon Mitigation Standards.  The rule is effective September 1st, but it only applies to new public buildings for which building permits are issued on or after April 1, 2013.  For more information, click here

STATE FIRE MARSHALL FILES PROPOSED RULES GOVERNING LPG PROGRAM
The Fire Marshall is proposing new rules regarding Liquefied Petroleum Gas (Propane) regulation in Oregon.  The last day for public comment is September 28, 2012.  For a copy of the proposed rules, contact Anita Phillips at 503-934-8264.

GOLF TOURNAMENT WAS GREAT
On August 1st just under 100 golfers and duffers converged at Stone Creek in Oregon City for the 2012 ORPHCC Golf Invitational.  It was a great day of golf and socializing between contractors and representatives from allied industries.  Participants spent nearly $1,000 on string and Mulligans (benefiting the ORPHCC campaign fund), and you know what that means about the skill level of those on the course!

The Columbia Chapter meets the 3rd Tues of each month, but we take a break in the summer.  So, the next meeting will be September 18th.  Our new location is McMenamins Old Church & Pub House in Wilsonville at 30340 SW Boones Ferry Road (same parking lot as the new Fred Meyer just off I-5).  You do not have to be an ORPHCC member to attend.  Cost is $30 per person.  Spouses and guests are welcome, too.

INDEPENDENT POLL SHOWS STARR AHEAD OF AVAKIAN
An independent poll by Public Policy Polling taken the weekend of June 22-24 showed State Senator Bruce Starr leading incumbent Labor Commissioner Brad Avakian 23% to 21% with 56% undecided.

The ORPHCC Legislative Committee met in Salem on March 7th and interviewed both Labor Commissioner
Brad Avakian (Democrat) and his challenger, State Senator Bruce Starr (Republican). Both candidates made impressive presentations and answered lots of questions. After the interviews, the Committee voted unanimously to endorse Bruce Starr for Labor Commissioner. This election will be decided in November. ORPHCC REPRESENTS INDUSTRY / SEEKS INPUT ON FOG RULES
ORPHCC Board Member Steve Houston has been invited to participate in a BCD task force reviewing the conflict between the Plumbing Code and local government rules on grease interceptors and traps. New language and standards are being discussed on 1014.1 (what shall be connected), 1014.1.3 (additional items connected) and 1014.2.2 and 1014.3.6.1 (interceptor type and sizing). However, other topics may also be considered. If you would like to provide input to the task force, please contact Steve Houston at s.houston@americanheating.net. ORPHCC is working for you and together, we do make a difference.
BCD ADOPTS RULES CREATING SPECIALIZED FINAL INSPECTOR CERTIFICATIONS

RENEWABLE ENERGY DEVELOPMENT GRANTS ADVISORY COMMITTEE MEETING MAY 10th
The Oregon Department of Energy has scheduled a meeting of the Renewable Energy Development Grants Advisory Committee.  It will meet on May 10th from 1:00 - 3:30 pm.  The meeting will be at the DOE’s main office at 625 Marion Street, NE in Salem.  This advisory committee was created by a 2011 law which replaced the Business Energy Tax Credit program.  Public hearings on permanent rules will be scheduled in June, 2012.  For more information, contact Maureen Block at 503-934-4004 or 800-221-8035. 

BETC FEE AND RULEMAKING MEETING MAY 11th

ENERGY CONSERVATION DRAFT PERMANENT RULES

ORPHCC ENDORSES BRUCE STARR FOR LABOR COMMISSIONER
The ORPHCC Legislative Committee met in Salem on March 7th and interviewed both Labor Commissioner Brad Avakian and his challenger.  Both candidates made impressive presentations and answered lots of questions.  After the interviews, the Committee voted unanimously to endorse Bruce Starr for Labor Commissioner.  This election will be decided on May 15th, not in November.  ORPHCC encourages you to learn more about both candidates and hopes you will vote for Bruce Starr.  To learn more about Senator Starr and to help him campaign, go to www.brucestarr.org

A NOTE FROM TERRY SWISHER, CHIEF PLUMBING INSPECTOR
The Building Codes Division has received a few complaints about local sanitary districts requiring different standards than adopted in the Oregon plumbing code for Fats, Oils and Grease (FOG) interceptors.  BCD would like to know if ORPHCC members are having similar problems during construction of food service facilities regarding local FOG programs setting different installation standards.  If you are having FOG problems, please notify Shane Sumption at 503-378-2015 so BCD can track the size and scope of this problem.  Thank you.

EPA APPROVES REVISIONS TO OREGON WATER QUALITY STANDARDS
On Oct. 17, 2011, the U.S. Environmental Protection Agency (EPA) approved revisions to Oregon's water quality standards designed to reduce or prevent toxic pollutants in Oregon waterways. In conjunction with revisions to the human health standards, DEQ revised certain water quality rules to clarify procedures and create new permitting tools (i.e. intake credits, a site-specific background pollutant criterion, and a revised variance rule) for implementing the standards. 2011 PLUMBING SPECIALTY CODE CHANGES EDUCATION
ORPHCC is close to final approval from the Building Codes Division on our 2011 Plumbing Specialty Code Change continuing education classes.  The live and online versions each will cost only $20.  We are tentatively planning our first class on Saturday, Oct 29th at Salishan.  Assuming state approval soon, our tentative classroom schedule is:

STATE PLUMBING BOARD MEETING

NEWLY ADOPTED REACH CODE RULE
This newly adopted rule, effective Oct 1st Amends the 2011 Oregon Reach Code by Adopting Residential Provisions.
NEW RULE: ESTABLISHING SPECIALIZED ELECTRICAL INSPECTOR TRAINING & CERTIFICATIONS
ORPHCC is closely monitoring this process which includes trends toward the same kind of changes in plumbing and mechanical trades inspections.  ORPHCC welcomes input from members on how these potential changes will impact your business and the work you do.

A MESSAGE FROM JIM NICKS / INSPECTION SERVICES MANAGER FOR PORTLAND
It has come to my attention that there may be some confusion about staffing or areas of responsibility within our Plumbing Program, so I am writing to provide clarification.
As you may know, Ken Carlson was our Commercial Plumbing Inspections Section Manager for many years. Ken retired in 2009, and about that time BDS was faced with an approximate 50% reduction in revenues due to the recession. We were compelled to make deep staffing cuts of about 50 %, including management positions. Upon Ken's retirement his position was cut, however the role of Chief Plumbing Inspector was assigned to Hank McDonald [503-823-9258]. Feel free to contact Hank with any plumbing related questions, either residential or commercial. We recognize the importance of having a designated Chief and we plan to continue to do so.
Another change resulting from the staffing cuts is three formerly distinct sections [Commercial Plumbing, Electrical and Structural/Mechanical sections] were merged, and one section manager was assigned to the newly combined section. That section manager is David Roshak [503-823-7273], who is also  BDS's Chief Electrical Inspector. Our plumbing inspectors report to David for administrative purposes but have full access to Hank for any code or technical plumbing questions.
BDS currently has three Senior Plumbing Inspectors; Wes Cooke in the Facility Permit Program, John Sisk in Residential Inspections, and McKenzie James in Commercial Inspections. McKenzie handles the bulk of our commercial plumbing plan reviews, though we have cross trained and begun assigning some plan review work to our three Commercial Plumbing Inspectors [District Inspectors] as needed to improve turnaround times.
To recap, we have one designated Chief, three Senior Plumbing Inspectors, three Commercial Plumbing Inspectors, and three Combination Inspectors [Residential] who hold A level plumbing certifications.

2011 PLUMBING SPECIALTY CODE CHANGES EDUCATION
The State of Oregon renewed its contract with ORPHCC to provide low-cost 2011 Plumbing Code Change education to licensed plumbers.  ORPHCC is developing both live classroom seminars across the state and an on-demand online version of the course.  Each will cost only $20.  The online version should be available starting in October and live classes will start in October, too.  More information and a schedule of dates and locations will be available soon.

ANNUAL ORPHCC CONFERENCE (AND GOLF)

EQC ADOPTS NEW GRAYWATER RULES
On August 25, 2011, the Oregon Environmental Quality Commission approved rules that create a new, statewide program for the permitting of graywater reuse and disposal systems. House Bill 2080, passed by the 2009 Oregon Legislature, directed development and adoption of these rules. DEQ administers the graywater permitting program and is in the process of developing permits and formalizing the program. DEQ expects to begin issuing permits for graywater reuse and disposal systems in spring 2012.

NLRB REQUIRES NEW POSTER BEGINNING IN NOVEMBER
The National Labor Relations Board has issued a Final Rule requiring most private-sector employers to notify employees of their rights under the National Labor Relations Act by posting a notice.  Employers should begin posting the notice on November 14, 2011. Copies of the notice will be available on the NLRB website and from NLRB regional offices by October 1.  The poster will be free to download.  You will not need to purchase a poster for your workplace.

EPA ANNOUNCES NEW ENERGY STAR REQUIREMENTS FOR DISHWASHERS & FURNACES
The EPA is updating Energy Star requirements for home dishwashers and furnaces. Effective Jan 20, 2012, standard-sized and compact home dishwashers meeting the new Energy Star requirements will be between 10% and 30% more energy efficient than conventional models, and about 8% more efficient than dishwashers that met the previous Energy Star requirement.  Here are links with more information:

ENERGY-EFFICIENCY UPGRADES CAN EARN BONUS INCENTIVES THIS FALL 
Energy Trust of Oregon is helping commercial and industrial businesses who may be impacted by changes to Oregon state energy tax credits by providing bonus cash incentives for qualified lighting upgrades and custom capital energy-efficiency improvements. The bonus incentives are for eligible projects completed this year and served by Energy Trust’s Existing Buildings, Existing Multifamily or Production Efficiency programs.  "Energy Trust was able to use existing budgeted funds for these limited-time bonus incentive offerings. Our goal is to acquire as much cost-effective energy efficiency as we can, and to help businesses continue to invest during a time when they may be affected by state tax credit changes," said Peter West, director of energy programs. "Businesses can start saving right away and begin the year with lower operating costs."  For more information:

BOILER RULES RESCHEDULES MEETING
The Board of Boiler Rules has rescheduled its September 13, 2011 meeting date to Tuesday, October 4, 2011, at 9:30 a.m., in Conference Room A. The board will be reviewing and making a recommendation on the 2011 Oregon Boiler and Pressure Bessel Specialty Code.

ORPHCC RETOOLING TO BETTER SERVE MEMBERS AND ALLIED INDUSTRIES.
Changes at ORPHCC :

New office location:  ORPHCC has moved from Lake Oswego to Salem.  The new office address is 3340 Commercial St SE, Ste 210 / Salem, OR 97302.  The phone and fax numbers will remain the same (503-557-1203 phone / 503-557-0884 fax).

Staff:  Interim Executive Director Burton Weast retired April 1st.  Burton had long advocated on behalf of PHCC members and came out of retirement to serve as the interim executive director.  Tracy Rutten, our Deputy Executive Director, accepted a position with Western Advocates. 

Darrell Fuller has been retained as our new Executive Director.  He has more than twenty years’ experience in lobbying and association management in Oregon, and is working as an independent contractor.  He can be reached at Darrell@orphcc.com or 971-388-1786.

 Julie Fleck, our Apprenticeship Coordinator, will continue her effective service to our three apprenticeships programs.

COLUMBIA AND WILLAMETTE CHAPTER MEETINGS
The Columbia Chapter (Portland area) and Willamette Chapter (Salem area) will resume monthly dinner meetings in September. 

Columbia Chapter meets the third Tuesday of each month at the Wilsonville Holiday Inn.  All ORPHCC members are welcome.  Mark the following days on your calendar:  Sept. 20, Oct. 18, Nov. 15 and Dec. 20, 2011.

Willamette Chapter meets the second Tuesday of each month at Rudy’s at the Salem Golf Club.  All ORPHCC members are welcome.  Mark the following days on your calendar:  Sept. 13, Oct. 11, Nov. 8 and Dec. 13.  Sarah Mazze from Green Shares will discuss energy efficiency issues at the September 13th meeting.

REGIONAL MEETINGS
Next spring ORPHCC will plan regional meetings across Oregon to gauge interest in holding regular (quarterly or monthly) chapter meetings in other parts of the state besides Portland and Salem.  If you are interested in helping, please contact Darrell Fuller at darrell@orphcc.com or 971-388-1786.

CHANGES COMING TO ENERGY TAX CREDITS
Follow this link to an Oregon Dept. of Energy report on the changes coming to energy tax credits.  While the document states the legislation is awaiting the Governor’s signature, Gov. Kitzhaber signed the bill into law on August 5th.

2011 PLUMBING CODE CHANGES
The State of Oregon renewed its contract with ORPHCC to provide low-cost 2011 Plumbing Code Change education to licensed plumbers.  ORPHCC is developing both live classroom seminars across the state and an on-demand online version of the course.  Each will cost only $20.  More information and a schedule of dates and locations will be available soon.

Brenda Dant, Indiana PHCC Executive Director, is facilitating a panel discussion at the National PHCC convention next month in Minneapolis.  She is looking for contractors who are using social media (Facebook, Twitter, Linked In etc.) in their business.  You don't have to be an expert on the subject - she is looking for stories of all kinds to share - the good, the bad and the ugly!  If you have a story you are willing to share, please contact her at 317-575-9292 or brenda@iaphcc.com.
